Context and Clarity: Texas State University's H-1B Extension

This information is intended to provide factual context on the the university’s intent to file an H-1B extension and amendment (renewal) for a current employee hired full-time in 2023.

General Statement from Texas State University:  

Consistent with current Texas Workforce Commission guidance, the notice relates to an H‑1B extension and amendment (renewal) filing for an existing employee, not a new employee. The employee is a Texas State University graduate.  

The employee began working at Texas State as a student employee in 2022. The employee successfully applied for and earned a full-time position at Texas State in 2023, and again in 2026. Both positions were publicly posted and advertised.


Background and Information

What is this H-1B petition for? 

Consistent with current Texas Workforce Commission guidelines, the notice relates to an H‑1B extension and amendment (renewal) filing for an existing employee who has been employed by Texas State since August 2022 and is a Texas State University graduate.

According to guidance from the Texas Workforce Commission (TWC), “TWC does not consider H-1B renewals to be new petitions. As such, they will not be subject to TWC’s written approval. Changes in visa status for students or recent graduates of a Texas institution of higher education who, at the time of application, reside in the United States (for example an F-1 or J-1 visa holder who transfers to an H-1B visa holder) are also not considered a new petition under TWC’s purview.”  

The notification of the university’s intent to file the H-1B extension and amendment (renewal) was posted on the Texas State website on August 11, 2026, in accordance with federal statute.  

Why did Texas State pursue an H-1B filing for this job?

The university filed for the employee’s original H-1B in 2023 when the individual had a change of status from an F-1 student visa and started full-time employment at Texas State.

The current H-1B extension and amendment will be filed in anticipation of the employee’s original H-1B expiring Jan. 2027.
